By accessing our website, placing an order, creating an account, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue your use of our services immediately.

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Last Updated" date and, where appropriate, notifying you directly. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

2. Our Services

Setbet Fashion operates as a premium fashion retailer offering ethnic wear, contemporary fashion, bridal collections, menswear, and accessories. Our services include:

• Online and in-store browsing and purchase of fashion products.
• Custom tailoring and bespoke fashion services by prior appointment.
• Fashion consultation and styling advice.
• Seasonal collections, limited edition pieces, and exclusive collaborations.
• Customer loyalty programs, promotional offers, and membership benefits.
• Order tracking, delivery management, and after-sale support.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.

All product images displayed on our website are for illustrative purposes. Actual colors, textures, and dimensions may vary slightly due to screen calibration, lighting conditions during photography, and the natural properties of fabrics and materials. Such variations do not constitute grounds for returns unless accompanied by a manufacturing defect.

3. User Accounts

4. Orders & Purchases

4.1 Order Placement

By placing an order on our website or in-store, you are making an offer to purchase the selected products at the stated price. Your order is not confirmed until you receive an official order confirmation from us via email or SMS.

We reserve the right to cancel or refuse any order for reasons including, but not limited to, product unavailability, pricing errors, suspected fraudulent activity, or failure to meet eligibility requirements. If we cancel your order after payment has been received, we will issue a full refund within 7–10 business days.

4.2 Product Availability

All products are subject to availability. We make every effort to keep our inventory accurate, but we cannot guarantee that a product will be in stock at the time of your order. In the event that an item is unavailable, we will notify you promptly and offer you the option of a substitute product, backorder, or full refund.

4.3 Pricing

All prices listed are in Indian Rupees (INR) and are inclusive of applicable goods and services tax (GST) unless otherwise stated. We reserve the right to change our prices at any time without prior notice. Prices are confirmed at the time of checkout and will not change after your order is accepted.

Promotional prices and discount codes are valid only during the specified promotional period and may not be combined with other offers unless explicitly stated.

5. Payment Terms

We accept the following payment methods: credit and debit cards (Visa, Mastercard, RuPay), UPI payments (including Google Pay, PhonePe, Paytm), net banking, EMI options through eligible banks, and cash payments at our in-store location.

All online payments are processed through secure, PCI-compliant payment gateways. We do not store your complete card information on our servers. By providing your payment information, you authorize us to charge the total order amount, including any applicable taxes and shipping fees.

In the event of a payment dispute or chargeback, we reserve the right to suspend your account pending resolution. We will cooperate fully with payment providers and relevant authorities to resolve any fraudulent transaction disputes.

For custom tailoring orders, a non-refundable deposit of 50% of the total order value may be required at the time of booking. The remaining balance is due upon completion of the garment and before delivery.

6. Shipping & Delivery

We offer shipping across India through trusted courier partners. Delivery timelines vary depending on your location and the type of product ordered:

• Standard Delivery (Surat & nearby areas): 2–4 business days.
• Standard Delivery (Pan-India): 5–10 business days.
• Express Delivery: 2–3 business days (available for select locations at additional cost).
• Custom Tailoring Orders: Delivery timelines communicated at time of order based on complexity and specifications.

Shipping charges are calculated at checkout based on your delivery location and order value. Orders above a certain value threshold may qualify for free shipping, as communicated in our current promotions.

Risk of loss and title for products purchased from us transfer to you upon delivery. We are not responsible for delays caused by courier partners, natural disasters, government restrictions, or other circumstances beyond our reasonable control.

Please ensure that your delivery address is accurate at the time of ordering. We cannot be held responsible for non-delivery due to incorrect address information provided by you.

7. Returns & Exchanges

7.1 Return Policy

We want you to be completely satisfied with your Setbet Fashion purchase. If you are not happy with your order, we accept returns under the following conditions:

• Items must be returned within 15 days of the delivery date.
• Items must be in their original, unworn, unwashed condition with all tags attached.
• Items must be returned in their original packaging.
• A valid proof of purchase (order confirmation or receipt) must accompany the return.

7.2 Non-Returnable Items

• Custom-tailored or personalized items made to your specifications.
• Items marked as "Final Sale" or "Non-Returnable" at the time of purchase.
• Undergarments, lingerie, and swimwear for hygiene reasons.
• Items that have been worn, washed, altered, or damaged by the customer.
• Gift cards and vouchers.

7.3 Refund Process

Once your return is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 7–10 business days. Shipping costs for returns are borne by the customer unless the return is due to a manufacturing defect or our error.

7.4 Exchanges

We offer exchanges for a different size or color of the same product, subject to availability. To initiate an exchange, please contact us at info@setbet.fashion within 15 days of receiving your order.

8. Intellectual Property

All content on the Setbet Fashion website and materials, including but not limited to text, graphics, logos, images, design patterns, product photographs, and software, is the exclusive property of Setbet Fashion and is protected by applicable intellectual property laws of India and international copyright treaties.

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes only. You may not:

• Reproduce, distribute, or transmit any content without our prior written consent.
• Modify, adapt, or create derivative works from our content.
• Use our trademarks, trade names, logos, or service marks without explicit permission.

10. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Setbet Fashion and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of profits, revenue, data, or business opportunities.
• Interruption of business or service outages.
• Damages resulting from unauthorized access to your account.
• Damages resulting from reliance on information provided on our website.
• Any conduct or content of third-party websites linked from our platform.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount paid by you for the specific product or service giving rise to the claim, in the three months preceding the claim.

Nothing in these Terms limits our liability for death or personal injury resulting from our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable Indian law, including the Consumer Protection Act, 2019.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. The courts of Surat, Gujarat, India shall have exclusive jurisdiction over any disputes arising from or related to these Terms or your use of our services.

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any dispute informally. We are committed to working with our customers to find fair and reasonable resolutions.

For disputes that cannot be resolved informally, both parties agree to attempt mediation through a mutually agreed mediator before proceeding to litigation. The costs of mediation shall be shared equally between the parties unless agreed otherwise.

These Terms are subject to applicable Indian consumer protection laws, including the Consumer Protection Act, 2019, and the Information Technology Act, 2000 (as amended). Nothing in these Terms shall abridge any statutory rights you may have as a consumer under Indian law.

11.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11.2 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Setbet Fashion regarding your use of our services and supersede all prior agreements or understandings.
